KUALA LUMPUR: The High Court here has recorded a consent judgment between a 42-year-old cancer patient and an insurance company in a RM2.5mil lawsuit she filed against the latter.
In the judgment recorded before Judicial Commissioner Liza Chan Sow Keng here on Monday (March 29), businesswoman Tan Siew Wei and Great Eastern Life Assurance (Malaysia) Bhd achieved a full and final settlement in one of the two insurance policies she is claiming for.
In the settlement, a sum of RM500,000 was to be paid by the defendant to Tan as a full and final settlement of all the claims and demands which Tan has against the defendant, in respect to the particular policy.
Tan, who was diagnosed with Stage 4 cervical cancer in 2019, had sued the company for rejecting her critical illness insurance claims on allegations that she had broken the policy clause with a non-disclosure on her mental state, where she was diagnosed with an anxiety attack in February, 2017.
She is suing the company to claim for RM500,000, which is the basic sum assured from the first life insurance policy, and another RM2mil, the basic sum assured from her second life insurance policy.
The court ordered for the settlement sum to be paid before April 1 and did not make any order as to costs.
Neither party would have any further claim against the other after the settlement is completed. The policy shall be terminated with all the benefits and rights provided under the policy to cease.

KUALA LUMPUR: Pengurusan Air Selangor Sdn Bhd (Air Selangor) plans to carry out maintenance on several key assets this year, to ensure consumers can enjoy continuous water supply in the future.
Air Selangor corporate communications chief Elina Baseri in a statement today said the maintenance work had received the approval of the National Water Services Commission.
The maintenance work include the connection of new pipes near the Carlsberg factory at Persiaran Selangor, Section 15, Shah Alam, which would cause a 48-hour water supply disruption in some areas.
Elina said the work would be carried out on March 30, from 9am to 9pm, with scheduled water supply disruptions in five areas in Petaling, 14 areas in Klang and 12 areas in Shah Alam, while supply was expected to be fully restored by 9am, April 1.
Apart from that, she said the valve replacement work on the raw water pipeline from the Klang Gates Dam would cause a temporary shutdown of the Bukit Nanas and Wangsa Maju Water Treatment Plants (LRAs) and this would result in a scheduled water supply disruption for 68 hours.
Elina said the work would be carried out from 9am to 9pm on April 6, and it would cause water supply disruptions in 12 areas in Gombak and 46 areas in Kuala Lumpur, with full recovery expected by 5am on April 9.
“The duration of the water supply disruption and restoration time in the affected areas varies depending on the quantity of water supply, the distance of the consumers’ premises, and the water pressure in the distribution system,” she said.

IPOH: A customer service representative is at her wits' end after her e-commerce account was apparently hacked and her credit card used to buy more than RM18,000 worth of items.
Low Syuk Yee, 38, said she never received any one-time passwords from the issuing bank for the 25 transactions made within four hours on Aug 13 last year.
She subsequently lodged a police report as well as reports with the bank and online shopping platform.
She said the transactions amounting to RM18,437.40 were for the purchase of mobile and social media chat top-ups.
“The police said they would not be able to open an investigation into the matter, the online platform does not want to reveal details to me, and the bank said that I have to settle the monthly payment," she told a press conference organised by Perak MCA Public Service and Complaints Bureau chief Low Guo Nan on Tuesday (March 16).
She said she was at least able to stop the charges from being racked up further after getting a message from the bank about a transaction for RM812.40 on the night of Aug 13.
Syuk Yee said when she got the message from the bank, she immediately asked the bank to block her card.
“I also called the online platform, and the representative told me to change my password and make a police report.
“My transaction history on the site shows that I always only buy clothes and children’s items, and never spend more than RM500 per month.

KOTA KINABALU: Over 70 machines selling drinking water in the city here, have been found to be operating without a licence from the Health Ministry.
Sabah Community Development and People's Being Minister Shahelmy Yahya, who is also in charge of state health, said the finding was based on an operation conducted by the Ministry and District Health Department this morning.
The first operation saw officials inspecting about 100 machines.
The operation was an effort to enforce licensing on those operating such machines, as required under the Food Regulations 1985. The need for a licence was approved in 2012.
"When the Act was approved, many efforts and initiatives were carried out to ensure all machines selling drinking water obtained valid licences before operating," Shahelmy told reporters after the operation.
"Continuous awareness initiatives were carried out over the period of eight years. However, until today, of the 100 machines inspected, only 27 have a licence. Over 70 others have no licence from the Ministry," he added.
Shahelmy said the authorities would go all out to enforce the regulation, noting machines without a licence would be confiscated.
He stressed having a licence could ensure the quality of drinking water sold at the machines, noting it is everyone's responsibility to protect consumers' health.
Shahelmy also reminded the people to become a responsible citizens and play a role in breaking the Covid-19 chain of infection during the conditional movement control order.
